Jonathan Sahrbeck, a Cumberland County native, has dedicated his career to protecting people against crime and dishonesty. He served as an Assistant District Attorney in Massachusetts before returning to Maine, where he was elected District Attorney for Cumberland County in 2018. As DA, he focused on combatting the opioid epidemic and substance use disorder, as well as preventing domestic violence, elder and child abuse, and human trafficking.

The Maine Implied Warranty

In the words of the Maine Attorney General, “The Maine Implied Warranty is the little known law that protects Maine consumers from being sold seriously defective items. It can be an Unfair Trade Practice to refuse to honor the Maine Implied Warranty Law within four years of sale.

The basic test for possible violations of the implied warranty includes:

  • The item is seriously defective.
  • The consumer did not damage the item.
  • The item is still within its useful life and not simply worn out.

 

The meaning of this is that when you buy an item, it is supposed to last for four years. For example, if you buy a refrigerator, it is supposed to function as a refrigerator for four years, regardless of any manufacturer warranty or extended warranty that you purchase.

  1. It cannot be a used car.
  2. No abuse or damage took place aside from normal wear and tear.
  3. You must have proof of the date of purchase.

 

If you have an item or service that meets these criteria, the remedy is to contact the seller or manufacturer and request that they honor the Maine Implied Warranty law within 30 days of receiving your request. If they refuse or do not respond, legal options may be explored, including bringing a lawsuit to seek restitution. It is important to note, however, that there are no guarantees of a successful outcome.
